Foreign nationals may purchase land and property in Turkey in their own names provided that properties are located in towns (i.e. there must be a local government in the area where the property is and the property must be situated within the boundaries of that local government or borough). All transactions are due to estableshed legal frames. Therefore you will have a solicitor here who will help you in your property transactions with long experience to represent you. Please be advised that below is a general outline and these procedures can change.
1) Once you have made the decision to purchase a particular property, your solicitor will check with the Land Registry Office that: • The title to the property is in order • The person selling the property is the one that actually owns it. • Whether there are any charges on the property • All the building licences and permissions are in order • The terms and conditions stipulated by the seller are fair and just.
2) When all is verified at the Registry Office, and the purchase price & conditions agreed upon, you will sign the contract with the seller and your solicitor. You will be provided with a copy of this contract. Contract details • Yours and seller’s details • A legal description of the property • Purchase price • Amount of down payment (sometimes called "deposit") and payment plan • Description of the property • Items to be included in the sale • Conditions
3) The Land Registry Office provides documentation on the property details, which are then forwarded to the Military Headquarters for clearance along with a letter, a notarized copy of your passport, and 2 photographs. They will verify that you are able to purchase property in Turkey and ensure the property doesn't fall within a Military zone. This process can take several months. 4) Before you leave Turkey, it is adviced to obtain a tax number from the closest tax office as it is a new regulation in Turkey. To obtain a tax number, you will need a valid passport and a photocopy of your passport (details and photograph) To open a Turkish Bank Account, you will need; the tax card and passport(s) of all that are to sign on the account
5) When permission from the Military Headquarters has been received and the documents are returned, we will contact you to arrange your return to Turkey and to transfer the rest of the payment.
6) It is legally compulsory for both sides (the seller and the buyer) to be present at time of purchase at the Registry Office. But it is possible to authorise your solicitor or someone else. A translator is required to be present at this time so that everything can be translated for the foreign buyer. There is a fee for legal translation and notary authentication. At this stage two passport photographs are required for every person that is to appear on the Deeds (Tapu) along with notarized photocopies of each relevant passport. 7) Both purchaser and vendor are liable for a 1,5 % property transfer tax, based on the declared price of the property. 8) It is required by law to have an earthquake insurance. The yearly payment amount depends on property price and location. The acquired property may be resold or rented out and the proceeds may be transferred out of Turkey.
